POLICY

University faculty members have the responsibilities to teach, to engage in scholarly activities, and to provide service to the public. Sometimes faculty members engage in scholarly activities and public service that require the use of university facilities. These activities are encouraged as being essential to the continued intellectual growth and development of the faculty member and to the university's on-going service to its many and varied publics.

Normally, the university requires no disclosure of these activities or of the income they may generate. Such activities include, but are not limited to: (a) using practice rooms and instruments to prepare for a paid musical performance; (b) using a faculty office and office equipment to write a book, develop computer software, or compose a musical piece for which royalties are earned; (c) using university studios and equipment to create a sculpture, painting or other art form for which the artist subsequently receives compensation; and (d) using library facilities in support of any of the above noted activities.

The university may enter into a specific contract with a faculty member to support a commercial endeavor, scholarship, or public service which may generate income. Such support may include, but is not limited to: (a) released time or compensated leave for research, writing, and creative work, (b) monetary support for equipment, supplies, salary, travel and other university resources.

Examples of situations in which a contract or letter of agreement would be expected would include, but not be limited to: (a) using laboratory facilities or resources for commercial or paid consultation activities, (b) using computer facilities or resources for commercial or paid consultation activities, and (c) using library facilities for commercial or paid consulting activities when such use would be so extensive as to unduly inconvenience patrons or staff.

When the university enters into a contract or letter of agreement with a faculty member, the university's obligations and the faculty member's obligations, including reimbursement for resources used and sharing of income, will be stated in writing.
