Subject:  Presenting Matters to the Board of Trustees


POLICY

It is the purpose of the Board of Trustees to represent the people of Arkansas in formulating those operational policies that will implement the mission of the university as it strives to fulfill the educational needs of its public.  All actions of this board shall be executed within the constitutional prescriptions of the Constitution of the State of Arkansas.  It is the intent and desire of the board to consider those matters pertinent to the welfare of the university and to receive full information in its decision-making process.

PROCEDURES

Matters for First Consideration

  1. Matters for consideration at meetings of the Board of Trustees must appear on the official agenda, except for emergencies which are defined in Section 5 below.

  2. Matters for the agenda shall be submitted to the president of the university at least (14) days prior to the meeting of the board during which it is to be considered.

  3. The written petition shall include the subsequent information:
    1. Name, address and telephone number of petitioner

    2. Subject of petition

    3. Review of discussions held with the university's administrative staff to achieve relief germane to the matter to be considered, including disclosure that all official procedures of the university have been exhausted prior to the petition

    4. Cite others who are participating in the petition and those whose interests will be affected

    5. State if an oral presentation to the board is being requested.

  4. The president may accept, defer, or decline the petition for board consideration.
    1. If deferred or declined, the chairman and secretary of the board shall serve as appellate officers for consideration of the matter for board action if the petitioner elects to appeal the president's decision.

  5. An emergency situation as referred to in Section 1 above shall be determined by the president of the university or the trustees.  If a situation is ascertained to be an emergency, the time period in Section 2 above shall be waived.

  6. Members of the Board of Trustees and its designated officers shall reserve the right to introduce matters without prior notification.
Matters for Reconsideration
  1. Any matter which has been acted upon by the Board of Trustees may be appealed for reconsideration.

  2. A petition for reconsideration shall be subject to the same procedure specified for "Matters for First Consideration" as stated above, except that Sections 3c, 4 and 5 are waived as being inapplicable.  The petition shall embrace the following information in addition to the applicable sections noted above:

    1. Statement of grievance

    2. Date of earlier board action

    3. Justification for reconsideration by the board including explanation of intervening circumstances which should move the board to reconsider its previous action on this matter.

  3. All matters for reconsideration shall be considered without prejudice to the petitioner.
